California: the cover exemption and the two-feature rule
California's Swimming Pool Safety Act applies when a building permit is issued for a new or remodeled pool or spa at a private single-family home. Section 115922 then requires at least two of seven drowning prevention features: an isolating enclosure, removable mesh fencing to ASTM F2286 with a self-closing gate, a safety cover labeled to ASTM F1346-23, exit alarms on doors and windows that open to the spa, self-closing and self-latching door devices with a release at least 54 inches up, an ASTM F2208 water alarm, or another independently verified equal. Section 115925 exempts hot tubs and spas with locking safety covers that comply with ASTM F1346, so most covered hot tubs skip the list. The inspector checks the features before final approval.
Worked example: a Sacramento backyard
Say you install a 240V MyHotTub Victoria on a slab and pull an electrical permit. If the cover carries an ASTM F1346 label and locks, the spa is exempt under 115925. If the cover is not labeled, you need two features from 115922. Mesh fencing with a self-latching gate plus exit alarms on the patio door works. A safety cover plus a water alarm does not, because 115922(b) rules out that pair. Keep the cover label photo with your permit papers.
Florida: portable spas with a cover
Florida's Residential Swimming Pool Safety Act lists exemptions in section 515.37, including a portable spa with a safety cover that complies with ASTM F1346-91. An above-ground hot tub delivered and set on a pad is the typical case. A spa built into the ground or into a deck is treated more like a pool, so ask the county or city building department before you design it in.
Texas: no single-family state rule
Texas Health and Safety Code Chapter 757 sets pool yard enclosure rules for multiunit rental complexes and pools managed by property owners' associations. It does not set a barrier rule for a hot tub behind a single-family house. Many Texas cities adopt model pool and spa codes or their own ordinances, so the local rule is the one to check.
Arizona: an 8 foot test
A.R.S. 36-1681 requires a 5 foot wall, fence or barrier around a swimming pool or other contained body of water 18 inches or more deep and wider than 8 feet, intended for swimming. A 7 foot hot tub falls outside it. The law also exempts residences where all residents are at least 6, and it lets cities and counties keep or adopt ordinances that are equal or stricter, so a Phoenix area city can still require more.
Nevada: Clark County's 2024 code
Clark County's 2024 Pool and Spa Code, effective January 11, 2026, exempts a spa or hot tub with a lockable ASTM F1346 safety cover from the barrier requirement in section 305.1. Portable residential spas must be listed to UL 1563 or CSA C22.2 No. 218.1. Our Las Vegas hot tub permit guide covers the wiring and NV Energy costs.
What to check before you buy
- Ask the maker whether the included cover is labeled to ASTM F1346, and whether it locks.
- Call the building department about barrier rules and the electrical permit for your address.
- Check HOA rules, which can require screening or setbacks even when state law does not.

Frequently asked questions
Does a backyard hot tub need a fence?
In the five states we checked, usually not if it has a locking safety cover that meets ASTM F1346. California (HSC 115925), Florida (s. 515.37, portable spas) and Clark County, Nevada (2024 Pool and Spa Code 305.1) exempt covered spas. Texas Chapter 757 does not cover single-family homes, and Arizona's 36-1681 covers water wider than 8 feet. Your city can be stricter.
What is ASTM F1346?
It is the ASTM International performance standard for safety covers on pools, spas and hot tubs. California's 115922 asks for a cover labeled to F1346-23, and Florida's statute names F1346-91. Look for the label on the cover itself, not only the tub brochure.
What if my California spa does not have a compliant cover?
When a building permit is issued for a new or remodeled spa at a single-family home, HSC 115922 requires at least two of seven drowning prevention features, such as an isolating enclosure, removable mesh fencing with a self-latching gate, door exit alarms, self-closing door latches at 54 inches or an ASTM F2208 water alarm.
Can I combine a safety cover and a pool alarm in California?
No. Section 115922(b) says a safety cover plus a water alarm does not satisfy the two-feature rule, and neither does an exit alarm and a self-closing device on the same door.
Does Arizona's pool fence law apply to hot tubs?
Rarely. A.R.S. 36-1681 applies to water at least 18 inches deep and wider than 8 feet that is intended for swimming, and most hot tubs are narrower. It also exempts homes where all residents are 6 or older. Cities may adopt equal or stricter rules.
Does Texas require a fence around a hot tub?
Not under state law for a single-family home. Health and Safety Code Chapter 757 sets enclosure rules for pools at multiunit rental complexes and property owners' associations. Check your city's code.
Is a hot tub inspected for barriers in Las Vegas?
Clark County's 2024 Pool and Spa Code requires a barrier for pools but section 305.1 exempts a spa or hot tub with a lockable ASTM F1346 safety cover. The field wiring is still permitted and inspected.
