Hot tub permits, barriers and safety covers in Los Angeles, Dallas, Miami and Phoenix

Last updated by the Brevley & Sons editorial team

Short answer: In all four cities a locking ASTM F1346 safety cover replaces the fence for a typical hot tub, though Phoenix limits hard cover use to spas 8 feet wide or less. Permits follow the wiring: Miami exempts plug in tubs, Los Angeles issues express electrical permits for spa circuits, and Dallas requires an electrical permit for new circuits, and Phoenix sells an online add a circuit permit that homeowners can buy themselves.

Los Angeles: the express permit for spa wiring

Inside the City of Los Angeles, LADBS issues building and electrical permits; Santa Monica, Glendale, Burbank, Pasadena and unincorporated county areas run their own. LADBS Information Bulletin P/GI 2020-003 lists "swimming pool wiring and luminaire" among non engineered electrical work in existing residential buildings that can get an express permit, limited to under 600 volts and up to 400 amps. A free standing non masonry pool barrier fence is also an express item. California Health and Safety Code 115922 requires two of seven drowning prevention features when a building permit is issued for a new pool or spa at a single family home, and Section 115925 exempts spas with locking safety covers that comply with ASTM F1346.

Dallas: Chapter 62 and the 24 inch test

Dallas adopted the 2021 ISPSC with local amendments as Chapter 62, with penalties up to $2,000. Its amended 305.1 says spas and hot tubs with a lockable ASTM F 1346 cover are exempt from barrier sections 305.2 through 305.7. Without that cover, the barrier must be 48 inches high with no more than 2 inches of clearance over soil or 4 inches over a solid surface. The City's pool and spa checklist exempts a prefabricated pool at a one or two family home from the pool permit only if it is completely above grade, holds 5,000 gallons or less, and is under 24 inches deep, and it says electrical or plumbing work done with the installation needs its own permit. Building Inspection is at 320 E. Jefferson Blvd., 214-948-4480.

Miami: the plug in exemption

The City of Miami's exemption list, under City Code 10-5, names "setting up prefabricated, above-ground whirlpool or spa tubs that plug into a standard outlet and are not hardwired" under electrical work, and lists plug and play portable tubs under plumbing. A 240 volt tub on a new GFCI breaker is outside it. The City warns that exempt work must still meet code, zoning and flood regulations. Other Miami-Dade municipalities run their own building departments, so this applies only inside City of Miami limits. Florida Statute 515.37 exempts a portable spa with an ASTM F1346 safety cover from the pool barrier law. The Building Department is at 444 SW 2nd Ave, 4th floor, 305-416-1100.

Phoenix: the 8 foot hard cover rule

Phoenix Ordinance G-7397 adopted the 2024 ISPSC with amendments effective August 1, 2025. Its definition of a residential pool covers any structure for swimming or recreational bathing holding water over 18 inches deep, naming hot tubs and spas, consistent with A.R.S. 36-1681. Amended 305.9 exempts portable spas with an ASTM F1346 cover and lets a spa or hot tub use a hard safety cover that is latched or locked if the unit is no more than 8 feet wide at any point. The same section ends the old pre 1990 house wall exception when a new pool or spa, including a spa addition, is installed. The 2018 amendments still show up in search results; the 2024 text is the one in force. For the wiring, Phoenix's online permits brochure says residential permits let residents and contractors do minor electrical work including adding or extending circuits, and lists "Add or Extend Branch Circuit" as an online permit with an inspection scheduled when work is complete. Properties in historic districts or with unresolved non permitted construction cases are not eligible. A new in ground or built spa goes through the Pool and Spa Residential Permit Application instead, where electrical subpanels over 60 amps require electrical plans.

Worked example: a 120 V tub vs a 240 V tub in each city

Compare the MyHotTub Mesa, a 74 by 74 inch tub on a 120 volt, 15 amp GFCI cord, with the MyHotTub Victoria, 91 by 91 inches, 480 gallons, on a 240 volt GFCI breaker. In Miami, the Mesa on an existing suitable outlet needs no permit; the Victoria needs an electrical permit for its circuit. In Los Angeles, the Mesa adds no wiring if an outdoor GFCI outlet already exists, and the Victoria's circuit is an express permit. In Dallas, both tubs hold far under 5,000 gallons, so the 24 inch depth line and the electrical work decide the permits, and either one skips the fence with a locking F 1346 cover. In Phoenix, both tubs are under 8 feet wide (91 inches is about 7.6 feet), so a latched hard cover meets 305.9, and the Victoria's new circuit can go on the online add a circuit permit. In all four, budget for an F1346 labeled cover.

Frequently asked questions

Do I need a permit for a plug in hot tub in Miami?

Not in the City of Miami. Its Work Exempt from Permit page, under City Code 10-5, exempts prefabricated above ground spa tubs that plug into a standard outlet and are not hardwired. A hardwired 240 volt tub on a new circuit needs an electrical permit, and exempt work must still meet zoning and flood rules.

Do I need a permit for a hot tub in Los Angeles?

A new 240 volt circuit for a spa needs an electrical permit from LADBS, and swimming pool wiring is on the LADBS express permit list, so it can be issued without plan review. A 120 volt tub on an existing outdoor GFCI outlet adds no wiring.

Does a hot tub need a fence in Dallas?

Not if it has a lockable safety cover complying with ASTM F 1346. Dallas amended ISPSC 305.1 in Chapter 62 so that such spas skip barrier sections 305.2 to 305.7. Otherwise the barrier must be at least 48 inches high.

Does a hot tub need a fence in Phoenix?

Phoenix's 2024 ISPSC amendments, effective August 1, 2025, exempt portable spas with an ASTM F1346 cover and allow a latched or locked hard cover on spas or hot tubs no more than 8 feet wide. A tub larger than that, or without such a cover, needs a barrier.

Is a soft vinyl hot tub cover enough?

Only if it is a safety cover that complies with ASTM F1346 and locks. All four cities tie the exception to that standard, so check the label, not just the clips.

When should I heat my hot tub to avoid peak rates?

In Los Angeles, avoid LADWP's R-1B high peak of 1 to 4:59 p.m. weekdays. In Miami, avoid FPL's noon to 9 p.m. weekday peak from April through October. In Phoenix, avoid APS's 4 to 7 p.m. weekday peak. Dallas rates depend on your retail plan.

Can I wire a hot tub myself in Dallas or Phoenix?

In Dallas, the homeowner permit allows electrical repairs only after passing a City exam and does not allow building a swimming pool, so plan on a licensed electrician for a new spa circuit. Phoenix lets residents buy an online Add or Extend Branch Circuit permit, with a city inspection when the work is done.
